Hi,
The resturant rang my Dad and they are having an on-going disagreement as they felt that we should have paid for HALF of the meal!
My Dad has tried to explain that the money is, and never was, the issue and that they are wholly to blame.
They accept responsibility but say they are NOT obliged to report it under the Trading Standards Act (although we could report them).
My Dad told them what he would have done had he owned the resturant and the law concerning this situation.
By causing this fuss over £60, and NOT placing Patrick's safety at the height of this whole scenario has upset me a great deal.
Mark says at the very least they should have insisted we don't pay for the meal, written me/Patchy an apology and then prayed we wouldn't report them!
Instead, they've reported this to the police (so they're covered for insurers!), made a fuss over the cost of the meal and haven't behaved honourably.

How horrible Amanda! They don`t seem to have given much thought to the shock you all got, or the possible consequences for Patrick. Report them please, they shouldn`t get away with this. Red boots on! Kathleen x

Speak to your solicitor. He could write to them on your behalf threatening litigation. That should focus their attention.

Take it further Amanda, don't allow them to get away with it. A meal served in a restaurant comes under Contract Law and the Sale of Goods and Services Act 1982. There's an implied term that food must be of "satisfactory quality" and the restaurant must use "necessary care in preparing it". If not, you are entitled to a full or partial refund. As the nail found in your son's dessert was potentially a serious health risk you could also report the restaurant to the Food Standards Agency. I'd suggest you write to the restaurant stating your claim and also requesting compensation for an element of distress and disappointment by you and your son. Good luck! Carol

I have my Dad onto it (he's a solicitor) and brother (he's a barrister!) so between them they will hopefully sort it...
I very nearly read Law too, wish I had done sometimes although I have been brought up with it all round me! Even Mark worked in barrister's chambers when I met him, although that put him off the law for life! LOL
